18 minutes ago<\/span>Author: Swadhin Patel<\/span><\/p>\n<\/div>\n The Allahabad High Court has dismissed a petition by a Class XI student of Tagore Public School, Prayagraj, seeking permission to wear a headscarf (hijab) along with the prescribed school uniform.<\/p>\n <\/p>\n The case centred on whether a student can claim an enforceable right to modify a prescribed uniform on religious grounds.<\/p>\n The court observed that allowing individual students to change a common uniform on personal or religious grounds could undermine the purpose of a uniform and affect institutional discipline.<\/p>\n But what exactly did the court rule, why did the student\u2019s plea not succeed, and does the judgment mean that hijab is banned in schools and India heading towards clearer school dress codes? Let us understand.<\/p>\n <\/p>\n Why did the court uphold the school\u2019s uniform policy?<\/strong><\/p>\n The petitioner sought permission to wear a headscarf along with the prescribed school uniform.<\/p>\n She argued that wearing the headscarf was part of her religious practice and was protected under Articles 14, 19(1)(a) and 25 of the Constitution.<\/p>\n The High Court held that private unaided schools have autonomy to prescribe and enforce uniform rules when those rules are bona fide, non-discriminatory and intended to maintain discipline and institutional identity.<\/p>\n At the same time, the court clarified that being privately managed does not automatically place an educational institution outside the writ jurisdiction of the High Court. Imparting education is a public function that can be entrusted to private institutions in pursuit of the broader objective of providing effective and accessible education.<\/p>\n Talking to Bhaskar English, Delhi High Court Advocate Ragini Sharma said the school\u2019s requirement was aimed at maintaining institutional discipline rather than interfering with the student\u2019s freedom of conscience or religious belief.<\/p>\n Sharma said the judgment appropriately recognises the autonomy of educational institutions to prescribe and enforce a uniform dress code.<\/p>\n In her view, such a policy promotes discipline, equality and inclusivity while keeping the classroom focused on education rather than religious or social differences.<\/p>\n Why did the \u2018essential religious practice\u2019 argument not succeed?<\/strong><\/p>\n Another important aspect of the case was the petitioner\u2019s claim that wearing a headscarf constituted an essential religious practice.<\/p>\n Sharma said the court found that there was insufficient pleading or material to show that wearing a headscarf was indispensable to the Islamic faith. She also pointed to the fact that other girl students from the same religious community were not wearing a headscarf as a relevant consideration before the court.<\/p>\n She added whenever this issue has arisen, various High Courts have consistently held that wearing a headscarf cannot, in itself, be regarded as an essential and indispensable part of the Islamic faith, the non-observance of which would jeopardise a woman\u2019s religious identity.<\/p>\n Is this a ban on hijab?<\/strong><\/p>\n The ruling does not concern whether Muslim women can generally wear hijab. The issue before the court was narrower: whether a student can seek an exception from a school\u2019s uniform policy by claiming that wearing a hijab is an essential religious practice.<\/p>\n Talking to Bhaskar English social activist Amber Zaidi said this distinction between an individual\u2019s religious practice and an institution\u2019s dress code is important.<\/p>\n \u201cAny institution has the right to apply its dress code. If it is applying the dress code, then we follow it,\u201d Zaidi said.<\/p>\n What does the ruling mean for individual freedom?<\/strong><\/p>\n The case raises a broader question about where individual religious freedom ends and institutional rules begin.<\/p>\n Zaidi said students retain the freedom to make personal choices in their private lives, while schools can prescribe reasonable dress requirements for students on campus. In her view, a uniform is intended to create a sense of equality among students.<\/p>\n \u201cWe go there to learn, where Hindu, Muslim, every religion are all together, we rise above discrimination and practise uniformity,\u201d she said.<\/p>\n What is the larger significance of the judgment?<\/strong><\/p>\n At the heart of the ruling is a balance between individual rights and institutional autonomy.
