The Centre has sought permission from the Supreme Court to conduct the service allocation process for 958 selected candidates of CSE-2025 based on the old OBC creamy layer criteria.<\/p>\n<p><span style=\"font-size:0\"\/><\/p>\n<p class=\"\" style=\"word-break:break-word;text-align:left;white-space:pre-line\">The Supreme Court had ruled on March 11 in the case of <em>Union of India vs Rohit Nathan<\/em> regarding the identification of the OBC creamy layer. The court said that the October 14, 2004 clarification letter could not alter the Office Memorandum (OM) issued on September 8, 1993.<\/p>\n<p class=\"\" style=\"word-break:break-word;text-align:left;white-space:pre-line\">The court also said that a candidate cannot be included in the OBC creamy layer solely on the basis of the salary or income of their parents. The status of the parents\u2019 posts, along with income and property-related criteria, must also be considered.<\/p>\n<p class=\"\" style=\"word-break:break-word;text-align:left;white-space:pre-line\"><strong>Centre\u2019s argument: Candidates appeared for the exam under old rules<\/strong><\/p>\n<p><span style=\"font-size:0\"\/><span style=\"font-size:0\"\/><\/p>\n<p class=\"\" style=\"word-break:break-word;text-align:left;white-space:pre-line\">The Centre said the CSE-2025 examination process had begun before the March 11 judgment. The notification was issued on January 22, 2025. The prelims were held on May 25, while the mains were conducted from August 22 to 31, 2025. The results of 958 candidates were declared on March 6, 2026. Five days later, on March 11, the Supreme Court delivered its new judgment.<\/p>\n<p class=\"\" style=\"word-break:break-word;text-align:left;white-space:pre-line\">According to the Centre, if the new judgment is applied retrospectively, it could lead to discrimination against candidates who appeared for the examination based on the old rules.<\/p>\n<p class=\"\" style=\"word-break:break-word;text-align:left;white-space:pre-line\"><strong>OBC candidates could lose age relaxation and attempts<\/strong><\/p>\n<p class=\"\" style=\"word-break:break-word;text-align:left;white-space:pre-line\">The Centre said that under the old rules, some candidates may have considered themselves ineligible for OBC-NCL status. This was particularly the case for candidates whose parents worked in PSUs or private companies and whose income exceeded the prescribed limit.<\/p>\n<p class=\"\" style=\"word-break:break-word;text-align:left;white-space:pre-line\">Such candidates may have appeared in the General category or may not have applied under the OBC category. As a result, they did not get the three-year age relaxation and additional attempts available to OBC-NCL candidates.<\/p>\n<p class=\"\" style=\"word-break:break-word;text-align:left;white-space:pre-line\">At the same time, some candidates applied under the OBC category but could fall under the creamy layer following the new judgment. This could lead to different treatment of candidates who relied on the old rules.<\/p>\n<p class=\"\" style=\"word-break:break-word;text-align:left;white-space:pre-line\"><strong>Reverification could affect the entire examination process<\/strong><\/p>\n<p class=\"\" style=\"word-break:break-word;text-align:left;white-space:pre-line\">The government said that following the new judgment, the jobs and positions held by the parents of several candidates may have to be reverified.<\/p>\n<p class=\"\" style=\"word-break:break-word;text-align:left;white-space:pre-line\">If this verification is extended to candidates who did not apply under the OBC category, issues related to their category, age relaxation and additional attempts could also arise. This could create a situation where the entire CSE-2025 process may have to be restarted.<\/p>\n<p class=\"\" style=\"word-break:break-word;text-align:left;white-space:pre-line\"><strong>Delay in service allocation could affect training<\/strong><\/p>\n<p class=\"\" style=\"word-break:break-word;text-align:left;white-space:pre-line\">The Centre said the next stage of the process for the selected officers has to be completed according to schedule. Any delay could affect the Foundation Course and training at the Lal Bahadur Shastri National Academy of Administration (LBSNAA) in Mussoorie.<\/p>\n<p class=\"\" style=\"word-break:break-word;text-align:left;white-space:pre-line\">According to the government, a delay in service allocation could also affect IAS-IPS cadres, seniority, salaries and training for other services.<\/p>\n<p class=\"\" style=\"word-break:break-word;text-align:left;white-space:pre-line\">Therefore, the Centre has asked the Supreme Court for permission to complete the service allocation process for the 958 selected candidates based on the old OBC creamy layer rules.
