Lok Sabha Speaker Om Birla has asked the rebel TMC MPs to respond to the disqualification petitions by 22 September.<\/p>\n

TMC leader Abhishek Banerjee had asked the Speaker on 18 June to disqualify 20 rebel TMC MPs.<\/p>\n

He had filed disqualification petitions against them under the Tenth Schedule of the Constitution.<\/p>\n

The MPs have merged with the Nationalist Citizens Party of India (NCPI).<\/p>\n

According to a letter from the Lok Sabha Secretariat, Joint Secretary Santosh Kumar told the rebel MPs that they would have to respond to the petitions after three weeks.<\/p>\n

On 14 June, the 20 TMC MPs had declared themselves a separate group. They later announced their support for the NDA.<\/p>\n

20 rebel MPs seek faster action against them<\/strong><\/p>\n

Earlier, TMC parliamentary party leader Abhishek Banerjee had met Lok Sabha Speaker Om Birla on Thursday.<\/p>\n

During the 20-minute meeting, the TMC asked the Speaker to speed up the disqualification proceedings against the 20 rebel MPs.<\/p>\n

Speaker Om Birla has made separate seating arrangements in the House for the 20 MPs who broke away from the TMC. However, their merger has not yet been approved.<\/p>\n

Abhishek Banerjee had also approached the Supreme Court over the matter.<\/p>\n

During the hearing, Solicitor General Tushar Mehta, appearing for the Lok Sabha Speaker and the Secretary-General, told the bench that the Speaker had issued notices to all 20 MPs on the disqualification petitions filed by the TMC under the Tenth Schedule.<\/p>\n

Rule for forming a separate group from a political party<\/strong><\/p>\n

Under the anti-defection law (Tenth Schedule), a separate group is recognised only when at least two-thirds of a party’s MLAs or MPs support it.<\/p>\n

In the case of the TMC, the situation is currently as follows:<\/p>\n

In the state Assembly, 58 of Mamata Banerjee’s 80 MLAs have broken away. This means the rebel group has the support of more than two-thirds of the MLAs.<\/p>\n

In the Lok Sabha, 20 of the TMC’s 28 MPs have rebelled. This means the rebel group also has more than the required two-thirds majority in the Lok Sabha.<\/p>\n

Two-thirds of the members of a political party can merge with another party or form a separate group and seek recognition.<\/p>\n

The final decision is taken by the Assembly Speaker, Lok Sabha Speaker or Rajya Sabha Chairman, depending on the House concerned.<\/p>\n

However, the Mamata Banerjee-led TMC faction may challenge the entire matter in court.<\/p>\n
