He said it was extremely distressing when IPS officers themselves appeared to be attacking protesters.<\/p>\n<p><span style=\"font-size:0\"\/><\/p>\n<p class=\"\" style=\"word-break:break-word;text-align:left;white-space:pre-line\">Justice Bhuyan said that the impartiality expected of the police seemed to be disappearing. The police must change their attitude. He also said that custodial deaths and fake encounters are serious crimes.<\/p>\n<p class=\"\" style=\"word-break:break-word;text-align:left;white-space:pre-line\">Justice Bhuyan said that a police officer deployed on the street is a symbol of the power of the state for ordinary people. When facing a problem, citizens turn to the police for help; therefore, it is essential to maintain trust in the police.<\/p>\n<p class=\"\" style=\"word-break:break-word;text-align:left;white-space:pre-line\"><span class=\"e913fbaa d3886593\"><strong>Justice Bhuyan expresses concern over custodial deaths and torture<\/strong><\/span><strong\/><\/p>\n<p><span style=\"font-size:0\"\/><span style=\"font-size:0\"\/><\/p>\n<p class=\"\" style=\"word-break:break-word;text-align:left;white-space:pre-line\">Justice Bhuyan expressed concern over the rising cases of custodial torture and deaths. He said that in a civilized society, custodial death is an extremely serious crime. Under no circumstances can the police subject any person to torture or inhumane treatment.<\/p>\n<p class=\"\" style=\"word-break:break-word;text-align:left;white-space:pre-line\">Referring to the 1997 case of <em>D.K. Basu v. State of West Bengal<\/em>, he said that citizens&#8217; fundamental rights do not end after arrest.<\/p>\n<p class=\"\" style=\"word-break:break-word;text-align:left;white-space:pre-line\">He asked whether a person&#8217;s right to life comes to an end after being arrested by the police. He said the answer is clear-no.<\/p>\n<p class=\"\" style=\"word-break:break-word;text-align:left;white-space:pre-line\">Justice Bhuyan said that in the D.K. Basu case, the Supreme Court had laid down several rules for the police during arrests and interrogations. It had also stated that victims should be compensated for violations of human rights.<\/p>\n<p class=\"\" style=\"word-break:break-word;text-align:left;white-space:pre-line\">He said that when government officials themselves break the law, people&#8217;s faith in the law declines and anarchy increases. Such a situation cannot be accepted in a civilized society.<\/p>\n<p class=\"\" style=\"word-break:break-word;text-align:left;white-space:pre-line\"><span class=\"e913fbaa d3886593\"><strong>Justice Bhuyan says-Political interference weakens police independence<\/strong><\/span><strong\/><\/p>\n<p class=\"\" style=\"word-break:break-word;text-align:left;white-space:pre-line\">Justice Bhuyan expressed concern over police reforms and the danger of political interference. He referred to the National Police Commission, established in 1977, which had made several recommendations on the police system and citizens&#8217; rights. The commission submitted its final report in May 1981.<\/p>\n<p class=\"\" style=\"word-break:break-word;text-align:left;white-space:pre-line\">He said that the commission had recommended investigating complaints against the police and granting the police professional independence, but these recommendations were not implemented.<\/p>\n<p class=\"\" style=\"word-break:break-word;text-align:left;white-space:pre-line\">After this, in 2006, the Supreme Court issued directives for police reforms in the Prakash Singh case. These included establishing a State Security Commission, ensuring a minimum tenure for the DGP, separating police investigations, and setting up Police Complaints Authorities.<\/p>\n<p class=\"\" style=\"word-break:break-word;text-align:left;white-space:pre-line\">Justice Bhuyan said that political and administrative pressure could lead to the misuse of the police and weaken the rule of law.<\/p>\n<p class=\"\" style=\"word-break:break-word;text-align:left;white-space:pre-line\">Justice Bhuyan expressed concern over the ongoing violence in Manipur. He said that peace remains elusive in this state, which is rich in talent and culture.<\/p>\n<p class=\"\" style=\"word-break:break-word;text-align:left;white-space:pre-line\">He said that violence continues despite the large presence of the police, Manipur Rifles, Assam Rifles, paramilitary forces, and the Army.
